Принцип верховенства права у діяльності центрів з надання безоплатної правничої допомоги: проблеми теорії та практики

Abstract

У статті досліджено теоретичні та практичні аспекти реалізації принципу верховенства права у діяльності центрів з надання БПД. Акцентовано на багатоаспектному вимірі цього принципу, що охоплює реальну доступність правничої допомоги, її ефективність, процедурну правову визначеність, незалежність адвокатів, рівність сторін у процесі та ефективний судовий контроль. Виявлено системні проблеми функціонування системи БПД: обмежену фактичну доступність, недостатню нормативну визначеність, ризики неправомірного впливу на адвокатів, недосконалість механізмів контролю якості. The article provides a comprehensive analysis of the implementation of the rule of law principle in the activities of free legal aid centers in Ukraine. The theoretical foundations of the rule of law as a fundamental constitutional principle that determines the essential requirements for the functioning of the legal aid system are examined. The multifaceted nature of this principle in the context of providing free legal aid is analyzed, encompassing: real accessibility of legal aid for all categories of the population; ensuring its effectiveness rather than formality; procedural legal certainty; independence of lawyers from unlawful influence; equality of arms in proceedings; prevention of pressure from pre-trial investigation authorities; effective judicial control over compliance with the right to legal aid. Systemic problems in the functioning of the legal aid system that hinder the full implementation of the rule of law principle have been identified: limited actual accessibility of legal aid for certain categories of the population due to territorial, physical and informational barriers; insufficient normative certainty of procedural aspects of providing legal aid; risks of unlawful influence on lawyers by pre-trial investigation authorities; imperfection of quality control mechanisms for legal services; conflicts between different legislative acts; absence of effective sanctions for obstructing legal aid lawyers. The necessity of a comprehensive approach to resolving the identified problems is substantiated, which includes improving the legislative regulation of the legal aid system, strengthening procedural guarantees of lawyers' independence, introducing effective mechanisms of judicial control over compliance with the right to legal aid, and bringing national practice into compliance with European standards, particularly the case law of the European Court of Human Rights and Council of Europe standards.
