Співвідношення компетенції служби освітньої безпеки та суміжних підрозділів Національної поліції України

Abstract

У науковій статті з’ясовано співвідношення компетенції служби освітньої безпеки та суміжних підрозділів Національної поліції України, а саме підрозділів ювенальної превенції та патрульної поліції. Запропоновано відмежовувати адміністративно-правовий статус підрозділів ювенальної превенції та Управління організації служби освітньої безпеки Національної поліції за територіальним принципом; за часом, упродовж якого виконуються повноваження поліцейськими; за колом осіб, на яких розповсюджується компетенція. Визначено, що служба освітньої безпеки діє за трьома названими нами критеріями, а ювенальна превенція не застосовує профілактичних і правоохоронних функцій у закладах загальної середньої освіти, за якими закріплений інспектор служби освітньої безпеки. Проблемою визнано те, що не у всіх закладах діє проєкт «Служба освітньої безпеки». Саме тому ювенальна превенція продовжує перекривати безпековий аспект в інших освітніх закладах у межах своєї компетенції. Запропоновано два критерії співвідношення діяльності шкільних офіцерів поліції та інспекторів служби освітньої безпеки: термін реалізації проєкту й обсяг виконуваних завдань. Наголошено, що обидва проєкти не мають повсякчасного запровадження на всій території України, що дає можливість не обмежуватися лише ними, а розширювати напрями співпраці поліції та закладів загальної середньої освіти з метою забезпечення безпекової складової. З’ясовано, що ускладнення відмежування компетенції підрозділів служби освітньої безпеки від підрозділів ювенальної превенції та шкільних офіцерів поліції відбувається через відсутність єдиного підпорядкування інспекторів служби освітньої безпеки. Запропоновано з метою уникнення подвійного виконання профілактичної функції відмежовувати компетенцію вказаних підрозділів за критеріями. Запропоновано впровадити правило: якщо заклад освіти має інспектора служби освітньої безпеки незалежно від його підпорядкування, то шкільні офіцери поліції та інспектори ювенальної превенції не мають брати його для обслуговування, здійснення профілактичної та просвітницької діяльності. The scientific article clarifies the relationship between the competence of the educational security service and related units of the National Police of Ukraine, such as juvenile prevention units and patrol police. It is proposed to demarcate the administrative and legal status of juvenile prevention units and the Office of the Organization of the Educational Security Service of the National Police according to the territorial principle; according to the time during which police officers perform their duties; by the circle of persons to whom the competence is distributed. It was determined that the educational security service operates according to the three criteria we mentioned, and juvenile prevention does not apply preventive and law enforcement functions in general secondary education institutions, which are assigned an inspector of the educational security service. The fact that the “Educational Security Service” project does not operate in all institutions is recognized as a problem. That is why juvenile prevention continues to cover the security aspect in other educational institutions within its competence. Two criteria for the ratio of the activities of school police officers and inspectors of the educational security service are proposed: the project implementation period and the scope of the tasks performed. It was emphasized that both projects do not have a permanent implementation throughout the territory of Ukraine, which allows not to be limited only to them, but to expand the directions of cooperation between the police and general secondary education institutions in order to ensure the security component. It was found out that the complication of distinguishing the competence of units of the educational security service from units of juvenile prevention and school police officers occurs due to the lack of uniform subordination of inspectors of the educational security service. In order to avoid double performance of the preventive function, it is proposed to limit the competence of the specified divisions according to the criteria. It is proposed to introduce a rule: if an educational institution has an educational security inspector regardless of his subordination, then school police officers and juvenile prevention inspectors should not hire him for maintenance, preventive and educational activities.
