Класифікація категорії закон з погляду суб’єкта законотворчої діяльності

Abstract

У статті проаналізовано приписи Закону України «Про правотворчу діяльність», що відображають результати здійсненої суб’єктом законотворчості видової диференціації категорії закон. Аргументовано висновки, що відображають оцінку результатів законодавчо закріпленої класифікації категорії закон із погляду її відповідності Конституції України. Для вдосконалення видової диференціації законів у чинному національному законодавстві, запропоновано внести зміни до Закону України «Про правотворчу діяльність», конкретизувавши форму прийняття закону (юридична форма), а також визначити як самостійні різновиди закону принаймні такі нормативно-правові акти найвищої та вищої юридичної сили, відповідно: Конституцію України – Основний Закон України, закон України про внесення змін до Конституції України, закон України про встановлення державних символів та порядок їх використання та закон України про утворення, реорганізацію або ліквідацію суду. The article deals with analysis of the provisions of the Law of Ukraine “On Lawmaking Activity” which reflect the results of the specific differentiation of the category of law carried out by the lawmaking activity actor. The following conclusions are argued, which reflect the assessment of the results of the legislatively enshrined classification of the category of law in terms of its compliance with the Constitution of Ukraine: 1) the specific differentiation of laws carried out by the lawmaking actor generally deserves a positive assessment, as it reflects a fundamentally new approach to dividing the scope of the category of law, which is largely oriented towards the needs of the practical legal activity of the Parliament, in particular, the exercise by it of constitutionally defined powers in the field of lawmaking; 2) at the same time, the author examines the shortcomings of the considered approach to be the basis chosen by the lawmaking actor for carrying out this logical operation, which does not have the necessary degree of specification, as well as the practical results of the classification carried out, which are not fully consistent with the provisions of the Constitution of Ukraine; 3) in order to improve the specific differentiation of laws in the current national legislation, the author has proposed to amend the Law of Ukraine “On Lawmaking Activities”, specifying the form of adoption of the law (legal form), and also to establish as independent varieties of the law at least the following regulatories of the highest and higher legal force, respectively: the Constitution of Ukraine – the Fundamental Law of Ukraine, the Law of Ukraine on Amendments to the Constitution of Ukraine, the Law of Ukraine on the Establishment of State Symbols and the Procedure for Their Use, and the Law of Ukraine on the Formation, Reorganization or Liquidation of a Court.
