До питання судової експертизи об’єктів інтелектуальної власності: предмет, завдання та межі компетенції

Abstract

У статті розглядається питання судової експертизи об’єктів інтелектуальної власності. Охарактеризовано порядок проведення судової експертизи у сфері інтелектуальної власності. Зазначено, що в Україні з 2002 року дослідження об’єктів інтелектуальної власності проводиться в рамках окремо виділеного напрямку судової експертизи – «Експертиза в сфері інтелектуальної власності». Визначено: предмет, завдання, що ставляться на її вирішення. Наведено основні види судових експертиз у сфері інтелектуальної власності. Окреслено завдання судового експерта під час дослідження інтелектуальної власності. Наголошується на особливостях проведення експертиз у сфері інтелектуальної власності. Звертається увага на окремі моменти, яким експертам варто приділяти увагу при з’ясуванні обсягу необхідних спеціальних знань. The article considers the issue of forensic examination of intellectual property objects. The procedure for conducting forensic examination in the field of intellectual property is described. It is noted that in Ukraine since 2002, the study of intellectual property objects has been carried out within the framework of a separately allocated direction of forensic examination – «Expertise in the field of intellectual property». The following are determined: the subject, tasks set for its solution. The subject of forensic examination in the field of intellectual property is the factual data and circumstances of the case about the properties, signs, patterns of creation and use of intellectual property objects, their value, damages caused and economic transactions regarding these objects, which are important for pre-trial investigation or judicial proceedings and are established by applying special knowledge in the manner prescribed by law. The main types of forensic examinations in the field of intellectual property are given. Within the framework of each type of examination in the field of intellectual property, factual data and circumstances regarding the relevant objects of intellectual property law are established, since in most cases the object of research is inherent to a certain type of forensic examination. The tasks of a forensic expert during the study of intellectual property are outlined. The features of conducting examinations in the field of intellectual property are emphasized. Attention is drawn to certain points that experts should pay attention to when clarifying the scope of the necessary special knowledge.
