Abstract

У статті досліджується еволюція спадкового права крізь призму його історичного розвитку. Автори аналізують різні етапи формування спадкових відносин: від давніх цивілізацій до сучасних юридичних систем. У статті представлено огляд основних законодавчих актів, норм і традицій, що вплинули на регулювання спадковості в різних культурах. Особливу увагу приділено змінам, які відбулися під впливом соціально-економічних та політичних факторів, а також порівнянню підходів до спадкових відносин у різних країнах. Висновки статті окреслюють сучасні тенденції у спадковому праві та його перспективи в умовах глобалізації. Дослідження покликано поглибити розуміння спадкових відносин як складового елемента правової системи та сприяти подальшому вивченню цієї теми у науковому просторі. Під час підготовки наукової статті автори визначили за мету віднайти відповідь на питання правової природи спадкових відносин як форми переходу права власності на матеріальні та нематеріальні блага, а також розвитку спадкового права в різних культурах і правових системах від давніх часів до сьогодення. In preparing this article, the author set out to find an answer to the question of the legal nature of inheritance relations as a form of transfer of ownership of tangible and intangible assets, and the development of inheritance law in different cultures and legal systems, from ancient times to the present. The study of the development of inheritance relations has not lost its relevance today, as inheritance issues are becoming increasingly relevant in modern society due to the growing number of assets and complex financial instruments that require clear legal regulation. The study of the retrospective of inheritance law in different legal systems allows identifying common and distinctive features in the regulation of inheritance relations, which can help in the practical application of law, formation of new approaches to inheritance disputes and making a will. The article examines the evolution of inheritance law through the prism of its historical development. The authors analyze various stages of inheritance relations, from ancient civilizations to modern legal systems. The article provides an overview of the main legislative acts, norms and traditions that have influenced the regulation of inheritance in different cultures. Particular attention is paid to the changes that have occurred under the influence of socio-economic and political factors, as well as to the comparison of approaches to inheritance relations in different countries. The conclusions of the article outline current trends in inheritance law and its prospects in the context of globalization. The study aims to deepen the understanding of inheritance relations as an integral element of the legal system and to promote further research on this topic in the scientific community.
