Проаналізовано судову практику, зокрема рішення з Єдиного державного реєстру судових рішень, у яких такі електронні дані використовувалися для підтвердження фактів правовідносин між сторонами спору. Здійснено оцінку правової природи електронних доказів, визначено проблемні аспекти подання їх на перевірку автентичності. Особливу увагу приділено застосуванню положень ст. 100 Цивільного процесуального кодексу України щодо порядку подання електронних доказів та визначення їх оригінальності. Обґрунтовано критерії допустимості, достовірності, достатності та належності електронних доказів, а також запропоновано напрями вдосконалення процесуального законодавства з урахуванням сучасних цифрових реалій. The article explores the theoretical and practical aspects of using electronic evidence in civil proceedings of Ukraine, emphasizing the transformation of judicial processes under the conditions of martial law and the active implementation of digital technologies. The study highlights that the digitalization of justice not only ensures citizens’ right of access to the court during the war but also significantly improves the efficiency and transparency of the judicial system. The author analyzes the regulatory framework governing the submission and evaluation of electronic evidence, including documents signed with an electronic digital signature, email correspondence, and messages from instant messengers such as Viber and Telegram. Particular attention is paid to judicial practice regarding the admissibility and probative value of such evidence, as demonstrated by the analysis of relevant case law from the Unified State Register of Court Decisions. The article outlines the problematic aspects of the current legislation, such as the lack of clear procedural regulation for the use of screenshots and messages from messengers as independent types of electronic evidence, as well as the inconsistency in judicial approaches to their authentication. The author argues that screenshots, though widely used by participants in civil proceedings, require proper procedural confirmation of their origin and integrity. Based on the analysis of court cases, it is established that courts increasingly recognize screenshots as admissible evidence, provided they are supported by other digital data (metadata, timestamps, or expert confirmation). In addition, the research substantiates the need to supplement Article 128 of the Civil Procedure Code of Ukraine to legally recognize Viber and similar applications as legitimate tools for notifying participants of court proceedings. The author’s contribution consists in the formulation of practical proposals aimed at enhancing the digital capacity of the Ukrainian judiciary, closing legislative gaps, and developing a unified digital platform for secure document exchange. The study concludes that the modernization of procedural norms and the institutionalization of electronic evidence assessment are crucial for aligning Ukrainian justice with European standards of openness, accessibility, and technological advancement.
