З’ясовано, що протягом періоду 2016-2025 рр. спостерігалась тенденція до загального збільшення кількості облікованих випадків вчинення кримінальних правопорушень, передбачених ст. 299 Кримінального кодексу України (+483% або майже у шість разів), із особливо різким збільшенням у 2025 р. (+249%), однак кількість засуджених за аналізоване діяння залишається відносно незначною. Аналізуючи географію поширення випадків жорстокого поводження з тваринами встановлено нетипово високий показник їх реєстрації у Закарпатській області у 2025 р. Що стосується поширення жорстокого поводження з тваринами у інших регіонах нашої держави, то випадки такого діяння реєструються скрізь, перебуваючи у межах 0,1–0,8 випадків на 100 тис. населення. This article is devoted to identifying, describing, and explaining the extent, trends, and geographical distribution of the criminal offense provided for in Article 299 of the Criminal Code of Ukraine, based on official statistical data from law enforcement agencies. It has been established that the development of the crime situation in the field of combating animal cruelty over the past ten years can be divided into four stages: 1) the first stage, covering 2016–2017, when relatively stable and, compared to subsequent stages, low indicator values were observed (from 105 to 113 recorded cases); 2) the second stage falls within 2018–2020 and is characterized by a noticeable increase, compared to the previous stage, in the number of registered criminal offenses in this category (from 184 to 222 cases); 3) the third stage, covering 2021–2024, during which a certain instability in the figures is observed: following a decline in 2021–2022 (to 150 cases, which may have been due to the start of Russia’s full-scale invasion of Ukraine), there was a subsequent gradual recovery to 189 cases in 2024; 4) the fourth stage begins in 2025 and continues to the present. During this period, there was a sharp increase in the number of reported cases of animal cruelty–up 249% compared to 2024, reaching 659 cases. It has been established that from 2016 to 2025, the number of recorded cases of animal cruelty increased by 483%–or nearly sixfold–although the number of individuals convicted of animal cruelty remains relatively small compared to the total number of registered criminal offenses. An analysis of the geographical distribution of criminal offenses under Article 299 of the Criminal Code of Ukraine revealed an unusually high rate of such offenses in Zakarpattia Oblast in 2025. Аргументовано, що у чинному кримінальному законодавстві України відсутні єдині критерії криміналізації та пеналізації зазначених посягань. Запропоновано: 1) встановлювати відповідальність за групові посягання на життя чи здоров’я людини та за такі ж посягання, пов’язані з виконанням професійних або громадських обов’язків, у загальних нормах КК України; 2) криміналізувати такі посягання у спеціальних нормах лише у разі, якщо додаткові ознаки діяння суттєво підвищують ступінь його суспільної небезпечності порівняно із загальними нормами; 3) при конструюванні санкцій досліджуваних статей КК України уникати дублювання розмірів одного і того ж виду покарання у різних частинах цих статей. The article considers certain issues of criminalization and penalization of attacks on the life and health of a person committed with complicity. It is argued that the current criminal legislation of Ukraine lacks uniform criteria for criminalization and penalization of the above-mentioned offenses, and the life and health of a person act as the main direct object, and as an additional mandatory object of the structures of intentional criminal offenses committed with complicity, which are provided for by various sections of the Special Part of the Criminal Code of Ukraine. It is proposed: 1) establish liability for group attacks on human life or health and for the same attacks related to the performance of professional or public duties in the general norms of the Criminal Code of Ukraine (to recognize as aggravating circumstances the commission of criminal offenses provided for in Articles 115, 121, 122, 125, 126 of the Criminal Code of Ukraine by a group of persons or a group of persons in prior conspiracy, and as especially aggravating circumstances their commission by an organized group or criminal organization; to provide in Articles 121, 122, 125, 126 of the Criminal Code of Ukraine as an aggravating circumstance for the commission of criminal offenses provided for by these articles in connection with the performance of professional or public duty); 2) criminalize such encroachments in special norms only if additional features of the act significantly increase the degree of its social danger compared to general norms; 3) when constructing sanctions for the articles of the Criminal Code of Ukraine under study, avoid duplicating the size of the same type of punishment in different parts of these articles (the upper limit of the sanction for a less serious criminal offense should be the lower limit of the more serious one). 2025-01-01T00:00:00Z
